If you're a Non-Resident Digital Service Provider (NRDSP) operating in the Philippines, you’ve likely heard about the Value-Added Tax (VAT) on digital services under Republic Act No. ​ 12023 and Revenue Regulations No. ​ 3-2025. ​ But here’s the big question: Have you registered yet? The deadline for registration has been extended until July 01 2025, and time is running out!

Why Should NRDSPs Register for VAT?


The Philippine government has taken significant steps to regulate the digital economy, ensuring that all digital services consumed within the country are subject to VAT. ​ This includes services like online marketplaces, cloud services, online media and advertising, digital goods, and even teleconsultation platforms. ​ If your business provides these services to Philippine consumers, you are required to register with the Bureau of Internal Revenue (BIR) and comply with VAT regulations. ​

Failure to register comes with serious consequences, including penalties under Section 13 of RR No. ​ 3-2025 and even suspension of business operations under Section 12 of the same regulations. ​ Beyond compliance, registration also ensures transparency and accountability in the growing digital economy. ​


What’s the Registration Process? ​


The BIR has made the registration process straightforward. ​ NRDSPs can register through the VAT on Digital Services (VDS) Portal once it becomes available. ​ In the meantime, registration can be done via the Online Registration and Update System (ORUS) on the BIR website. ​ Here’s what you’ll need:

  1. Business Information: Name of the business entity, trade name, and registered foreign address. ​

  2. Authorized Representative Details: Name and Taxpayer Identification Number (TIN) of the local representative, if applicable. ​

  3. Contact Information: Email address and contact number. ​

  4. Official Registration Documents: Articles of Incorporation or Certificate of Tax Residency from the country of incorporation. ​

If you don’t have a local representative, don’t worry! ​ NRDSPs can register directly without appointing one, although you may choose to work with a resident third-party service provider for tax filing and reporting obligations. ​


What Happens After Registration?


Once registered, NRDSPs will be issued a BIR Certificate of Registration (COR) containing their assigned TIN and other registration details. ​ This certificate is essential for filing VAT returns and remitting VAT payments. NRDSPs will be liable for the 12% VAT on their gross sales from digital services consumed in the Philippines starting June 2, 2025. ​

For Business-to-Business (B2B) transactions, VAT will be accounted for using the reverse charge mechanism, where the Philippine buyer files and remits the VAT. ​ For Business-to-Consumer (B2C) transactions, the NRDSP is directly responsible for filing and paying the VAT. ​
